US Judge Blocks Trump Bid To Restrict Birthright Citizenship Order
On January 20, 2025, President Donald Trump issued an executive order titled “Protecting the Meaning and Value of American Citizenship,” aiming to end birthright citizenship for certain groups. Specifically, the order sought to deny automatic U.S. citizenship to children born in the country under two conditions:
When the mother was unlawfully present in the U.S., and the father was neither a U.S. citizen nor a lawful permanent resident at the time of birth.
When the mother was in the U.S. on a temporary status (e.g., student, work, or tourist visa), and the father was neither a U.S. citizen nor a lawful permanent resident at the time of birth.
The order was set to take effect on February 19, 2025.
However, this executive order faced immediate legal challenges. Attorneys general from 22 states filed lawsuits to block its implementation, arguing that it violated the 14th Amendment of the U.S. Constitution, which grants citizenship to all individuals born in the United States.
On January 23, 2025, U.S. District Judge John C. Coughenour in Seattle temporarily blocked the executive order, describing it as “blatantly unconstitutional.” This ruling prevents the order from taking effect while legal proceedings continue.
It’s important to note that a grand jury does not have the authority to suspend constitutional rights or enact policy changes. The suspension of birthright citizenship, as attempted by this executive order, is subject to judicial review and must align with constitutional provisions.
